The emergence of the global administrative sector and its new forms of knowledge production, expert rationality, and standardization, remains an understudied topic in science studies. Using a coproductionist theoretical framework, we argue tha the mutual construction of epistemic and legal authority across international organizations has been critical for constituting and stabilizing a global regime for the regulation of food safety. The authors demonstrate how this process has also given rise to an authoritative framework for risk analysis touted as ‘‘scientifically rigorous’’ (...) but embodying particular value choices regarding health, environment, and the dispensation of regulatory power. Finally, the authors trace how enrollment of the Codex Alimentarius in World Trade Law has heightened institutional dilemmas around legitimacy and credibility in science advice at the global level. Taken together, the case illustrates the importance of attending to the iterative construction of law and science in the constitution of new global administrative regimes. (shrink)

Memory theories of personal identity are subject to the difficulty that distinct simultaneous person stages may both stand in the memory relation to an earlier person stage. Apparently, Such theories entail that these two duplicate person stages are stages of the same person, A claim argued to be "obviously false". In this paper, I argue that the characteristics of these duplication cases usually cited to support this claim do not provide adequate evidence to make it cogent.

In place of the traditional epistemological view of knowledge as justified true belief we argue that artificial intelligence and law needs an evidence-based epistemology according to which scientific knowledge is based on critical analysis of evidence using argumentation. This new epistemology of scientific evidence (ESE) models scientific knowledge as achieved through a process of marshaling evidence in a scientific inquiry that results in a convergence of scientific theories and research results. We show how a dialogue interface of argument from expert (...) opinion, along with its set of critical questions, provides the argumentation component of the ESE. It enables internal scientific knowledge to be translated over into a wider arena in which individual nonexpert citizens and groups can make use of it. The external component shows how evidence is presented and used in a legal procedural setting that includes fact-finding, weighing the credibility of expert witnesses, and critical questioning of arguments. Since the inception of their subject as a distinct area of study in philosophy, environmental ethicists have quarreled over the choice of entities with which an environmental ethic should be concerned. A dichotomous ontology has arisen with the ethical atomists, e.g., Singer and Taylor, arguing for moral consideration of individual organisms and the holists, e.g., Rolston and Callicott, focussing on moral consideration of systems. This dichotomous view is ecologically misinformed and should be abandoned. In this paper, I argue that the (...) organization of the natural world, as viewed by some ecologists and evolutionary biologists, is structured on various levels that are not reducible to one another. This hierarchical view, expressed by Salthe and Eldredge, provides the most complete and accurate ontology for environmental ethics. (shrink)

Use of argumentation methods applied to legal reasoning is a relatively new field of study. The book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. This article studies institutional investor allocations to the socially responsible asset class. We propose two elements influence socially responsible institutional investment in private equity: internal organizational structure, and internationalization. We study socially responsible investments from Dutch institutional investments into private equity funds, and compare socially responsible investment across different asset classes and different types of institutional investors (banks, insurance companies, and pension funds). The data indicate socially responsible investment in private equity is 40–50% more common when the decision to implement (...) such an investment plan is centralised with a single chief investment officer. Socially responsible investment in private equity is also more common among institutional investors with a greater international investment focus, and less common among fund-of-fund private equity investments. 2. Before getting down to business, two assumptions underlying the subsequent discussion should be made explicit. The first concerns the choice of methods. Our problem is one of the proper description of a distinctive fact of consciousness, but there is an indirect as well as a direct manner of approach. The indirect approach would be to examine the structure of the language used in talk about such a feeling of freedom; the direct approach would be to employ to the full (...) our capacities of attention to the contents of consciousness. These linguistic and phenomenological methods are in many cases complementary, each suggesting to the other directions which might be followed to advantage. In the present case, however, the indirect approach seems ill-fitted to be of any substantial use, for it must be obvious, in the first place, that the relevant talk is found among professional philosophers only and, in the second place, where such talk is found it is confessedly meager beside that to which it is intended to draw our attention. Talk which concerns itself with the importance of attending to the phenomenon itself is peculiarly modest and self-effacing talk. Two studies reported in the Journal of Medical Ethics add to the growing body of qualitative evidence relating to the use of sedatives at the end of life.1 ,2 Respondents in the two studies affirm a number of important concerns, most of which have been elaborated in the philosophy and palliative care literature, relating to the use of sedation. There seems little doubt that the common moral thread to most of these concerns is the possibility that end-of-life sedation can resemble (...) assisted death.Most of the Dutch respondents in the paper by Reitjens et al1 were reported to believe that sedation does not hasten death. That is an oversimplification. Were it not for the potential to hasten death, I doubt we would be discussing the use of sedatives so frequently in ethics journals. It is true that there is little evidence that sedation significantly hastens death when doses are carefully titrated against symptoms—giving only that amount of a drug necessary to make the patient feel less distressed, and preserving consciousness as far as possible.3 Probably most sedative …. This paper examines whether Bruno Bauer's critical assessment of Jewish emancipation in Prussia is consistent with his other republican writings in the 1840s. It argues that Bauer's political position is a form of republican rigorism, according to which human emancipation requires identification with universal interests, and not the defence of particular identities. Rigorism involves the elimination of internal as well as external heteronomous influences, and implies shifting the boundaries between the juridical and the moral realms as defined by Kant. Subjects' (...) incentives for adopting the maxims that govern their external action are taken to be relevant to the assessment of the emancipatory potential of their deeds and claims. The paper distinguishes degrees of rigorism, and shows that Bauer's specific conclusions on the Jewish question, while not entirely unfounded by his political logic, are not strictly implied by his premises. Over the past decade, Zygmunt Bauman has published a series of books that sketch out a postmodern turn in society, theory, culture, ethics and politics. Changes in contemporary society and culture, Bauman argues, require new modes of thought, morality and politics to appropriately respond to the new social conditions. This requires a reconfiguration of critical social theory and new tasks for a postmodern sociology. Bauman thus poses fundamental challenges to contemporary social theory and provides an original and provocative post-modern version (...) of the sociological imagination, developing sketches of the fundamental social and cultural changes of our time, and the ways that theory and politics must be changed to creatively map and democratically respond to these questions. Bauman's critical reflections on modern theory and society, and his postmodern turn, require serious critical responses to his challenges to conventional wisdom and practice. In my study, I sketch out what I consider to be important in Bauman's recent work, what I see as problematical, and how Bauman's project — that is also my own — might be advanced. While my focus might appear to be predominantly critical, I attempt to generate a constructive dialogue with his thought that will advance our mutual interests and perhaps help illuminate some interesting contemporary topics and debates. This is a comprehensive study in English of Bruno Bauer, a leading Hegelian philosopher of the 1840s. Inspired by the philosophy of Hegel, Bauer led an intellectual revolution that influenced Marx and shaped modern secular humanism. In the process he offered a republican alternative to liberalism and socialism, criticized religious and political conservatism and set out the terms for the development of modern mass and industrial society. Based on in-depth archival research this book traces the emergence of republican political thought (...) in Germany before the revolutions of 1848. Professor Moggach examines Bauer's republicanism and his concept of infinite self-consciousness. He also explores the more disturbing aspects of Bauer's critique of modernity, such as his anti-Semitism. ABSTRACT The historical context of early post-Kantian debates on politics reveals the emergence of a new type of perfectionist ethics no longer based on the state-sponsored promotion of happiness, as the dominant German tendency in the eighteenth century had been, but on individual freedom. Post-Kantian perfectionism focused on maintaining and enhancing the conditions for rightful interaction among self-defining individuals. Rather than isolating and alienating, Kantian negative freedom enabled a new conception of social interaction based on the idea of right and (...) the progressive extension of rightful relations. Biobanking, the large-scale, systematic collection of data and tissue for open-ended research purposes, is on the rise, particularly in clinical research. The infrastructures for the systematic procurement, management and eventual use of human tissue and data are positioned between healthcare and research. However, the positioning of biobanking infrastructures and transfer of tissue and data between research and care is not an innocuous go-between. Instead, it involves changes in both domains and raises issues about how distinctions between research and care are (...) drawn and policed. Based on an analysis of the emergence and development of clinical biobanking in the Netherlands, this article explores how processes of bio-objectification associated with biobanking arise, redefining the ways in which distinctions between research and clinical care are governed. Using the model syntax of Pörn and the relatedness logic of Epstein, it is shown how St. Anselm's approach can reveal the logical form of some common action locutions.

To read any book by Paul Weiss is to enter into an ongoing philosophical discussion. Emphatics is no exception. Here Weiss takes up some issues from previous work but from a new angle of vision. Much of what he says also moves beyond the content of earlier writings, which is as it should be. "A creative, systematic philosopher," Weiss says, "is somewhat like a poet rewriting a long poem, preserving some parts of earlier versions in later ones. What has been (...) done is not invalidated, but moved beyond" (37). Another characteristic Weissian feature marks Emphatics: it is difficult to read. My purpose here is to provide a theoretical context for exploring what enables and prevents interreligious dialogue. My approach is to look at the possible attitudes within personal interactions that motivate and inform prejudice toward and acceptance of people of other religions and the possible attitudes that would mitigate it. I do not see religious tolerance and intolerance as an either/or relation but as varied phenomena that emerge from everyday human life. Societies and religions are many-sided, and personal interactions between (...) people of different religions reflect not only religious beliefs and traditions but the constellation of social forces and personal desires and fears.
